Social media has emerged over the past 20 years and the use of it has stirred up a debate with regards to applicable United States Constitutional Right. However, the first Amendment is not at time applicable to private companies. The first amendment only limits federal, state, and local governmental entities. Social media has also spread around the world becoming an essential part of daily life. Facebook, Google, and Twitter (to name just a few) have completely transformed the way people see, share, receive, perceive, and interpret information. This new technology has created a legal inquiry into the dynamics of social media and the spread of false information. Many legal and ethical concerns have been raised. There is an argument that the law is not yet equipped to handle social media with regards to safety (i.e. cybercrime, identity theft, cyberbullying, terrorism, and the threat to democracy). It can be contended that social media is a form of media or communication and just like any other media, it should be regulated. The first question, that I would like to answer is should the law regulate social media? I will offer via international law the different perspective of other countries and how those countries have regulated social media. The second question, What about the Constitutional Rights of Americans and how its applicable to social media. Lastly, what are the rights of the individual and is the first amendment applicable?
