Relationship imbalance among the three co-equal arms of government has had a negative effect on the quality and stability of democracy in Nigeria since 1999. It is thought that passive legislatures or rampaging heads and members of the executive were the only perpetrators. However, a more profound inquiry points to a disturbing involvement—or improper involvement—of the judicial branch. This sort of involvement is an emerging development previously unknown.
This book grapples with the question of whether the current use of judicial power to interface in all legislative-executive altercations is constitutional and legitimate. That executive in turn has come back to haunt the legislature, has not spared the judiciary and has become a constitutional emperor. It is in managing the legislative-executive scuffles that the judiciary has created divergent outcomes contrary to the dictate and spirit of the doctrine of separation of powers.
