The ratification of international instruments by a state is not always enough. The country has to take further steps of domestication by enacting the law to safeguard the provisions of that global legal framework. In this context, therefore, the author will argue for the necessity of an enactment to regulate and protect Agriculture products that have unique characteristics and qualities that have been attributed to Afghanistan. Despite the fact that Afghanistan is a member state of the World Trade Organization (WTO), TRIPS, and World Intellectual Property Organization (WIPO) still, there is no domestic law in Afghanistan to supersede the provisions of the international legal framework.
